
Advocates David Chaudhary and Sachit Rizal filed the petition in the Supreme Court
Kathmandu. A petition has been filed in the Supreme Court demanding cancellation of the royalty fee determined by the Music Royalty Collection Society.
Advocates David Choudhary and Sachit Rizal have filed a writ seeking an injunction to quash the notice on the determination of royalty fees published by the Royalty Collection Society on 30 August 2080 as it is in conflict with the Constitution.
The Office of the Prime Minister and the Council of Ministers, the Ministry of Law, Justice and Parliamentary Affairs and the Ministry of Culture, Tourism and Civil Aviation have been made opponents in the writ.
The notice of the society has been demanded to be canceled as it has been unfairly restricted on the fundamental rights provided in clause (1) of Article 133 of the Constitution or is in conflict with any law or constitution for any other reason.
In order to ensure that the person who has the right to produce the sound recordings can sell, distribute or restore the sound recordings with royalties, injunctions and other orders have been requested in the name of the opponent.
The hearing on this writ has been scheduled for Wednesday.
